he can apply for h4 in the USA, right? h4 for 485 pending --h4 is only used for secure reason, if 485 is rejected, he is still legal status from 6/30/2004 with h4, or he is stay in the states illegal, that is why he needs h4.

I think since his h-1 is already out of date, and he didn't apply for h4 before that date, that is why the lawyer says that he need to leave the states to get h4, right? I am not sure on that point.

currently, he is in legal status --485 pending.
