Since your H-1 has expired, USCIS may ask you why you did not file the COS timely when you were in H-1 status (general rule is your nonimmigrant status should not break for COS). But if the gap is not big, USCIS may just forget it and approve your H4 COS anyway.

The easiest way is to leave this country and apply a H-4 visa. Do not forget AP!
