Your current employer can file a new H-1B petition for you and you have no H-1 CAP problem (because your current status is AOS, not H-1B, you can not do H-1B transfer).

Once your hu*****and's I-140 is denied,then your both I-485 will be denied. Thus, your EAD will be invalid. Your status (AOS) will be terminated (you will be out of status), so you have to go back to China to get a valid visa (H-1 or H-4) back to U.S. Then you have a new legal status (H-1 or H-4).
