because you have left US for more than one year, that old OPT card or your old H1 I-797 really doesn't affect your new H1 petition anymore. However, you will need to show in US consulate to VO that you left US while in valid status (such as within 60 days of OPT expiration date) before VO will issue you H1 visa stamp. You should think now how to prove that, if without EAD.
