If your H1B approval I797 is still good, not withdrawn, maintaing H1 requirements, not working for others, etc. You will still be considered in H1 even if EAD is "used" for this H1 employment. Because you cannot claim to recapture H1 time for this period when you think you are using EAD but not H1. To USCIS, you still keep using H1, if you meet the above conditions.
