Based on the webpage you provided. I guess I could do the following things, but just want to confirm with you:
I re-new my H-1B. After I get the new H-1B, I go back to China and get married. After that, I come back using AP. Then My wife applies H-4. Then I file I-485 for her attaching to my current I-485 which has already been filed.
Right?
Actually I think I could apply for H-1B re-entry visa in China, and use that to come back. In that case, AP will be totally out of picture. Am I right? But I guess if I got rejected, I have to return to US as AP and work on EAD. Right? In that case, I will lost H-1B status.
The web page has the information till 2000. hopfully INS or the current BCIS wont change the regulations.
