I know by law/regulation, he shouldn't get new I-94

But what if somehow the I-797 approval notice for his H-1 application has new I-94 attached,
1) Does he still have to go abroad to get H-1 Visa?
2) Is his continuous staying in US legal as an H-1 non-immigrant?
3) Can someone legally "sandwiches" a perioud of AOS between two non-immigration statuses?
I know it is a gray area. Just want to have some technical discussion that might be helpful to someone. And they should definitely consult a competent attorney.
