EAD vs HB1: Xiaonaotu: please help

Xiaobaitu, I have two questions for you:

1. I am currently using my EAD (based on I-485) in a university. I want to have a H-1B visa. Would you think I can apply for the H-1B.

2. If there are a few weeks gap between my old EAD and new EAD being applied for, it is or isn't legal for a paid job within this gap?
