H1-B--I-485 pending--AP--(EAD or H1-B)?

I was H1-B before I am in I-485 pending. I got my I-485 pending as a dependent of my hu*****and's NIW I-140 approval. last month I used my AP entering U.S for my China trip. my family is relcating. both my hu*****and and I need to change employeers. my attoney told me that my hu*****and can apply for H1-B with no problem ( he is holding H1-B currently) but there might be problem if I reapply for H1-B instead of using EAD for my future job because I am not I-140 applicant.my attoney suggests that I should apply for EAD otherwise it would influence my I-485 processing. any opinions? thanks!
