EAD TO H visa Help!!!

I use EAD to work in university research center, I was H4 before. Our I-140 & 485 just been denied. I will have to go back to China to get back my legal status. My hu*****and is H1. Does anyone know if it is difficult to get H visa in China. I am going to try H4, my boss also very nice to support my H1. I heard that H visa is allowed to have immigration intent, should be approved. But who knows what will happen, could both of them are high risk after 485 denial?
Please give some suggestions or share your experience if you have, thanks!!!
