For my understanding, you can switch between EAD and H1B because H1B holder is allowed to have dual intention---both immigration and nonimmigration.

In your case, if you(or your spouse) have never had H1B before, I'm not sure if you will have problem to apply new H1B after 140/485 denial-----let's hope not, just prepare for the worst. If that's the case you should ask lawyer.

Usually H1B renewal is much easier to get.
