1. Use a Different Statutory Authority
If the Court struck down tariffs under IEEPA, a president could try to use:

Section 232 of the Trade Expansion Act (national security tariffs)

Section 301 of the Trade Act of 1974 (unfair trade practices)

2. Declare a New Emergency Under a Different Law
A president could attempt to declare a new emergency under a statute that does allow trade restrictions.

3. Ask Congress to Pass New Tariff Authority
Congress can always grant new tariff powers.
This is the cleanest constitutional route.
