按照宪法条文这行政令明显有违宪之嫌。到联邦地区法院就会被下禁止令，打上巡回上诉法院和最高法院也改变不了。

宪法第一条第四款：The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; （举行参议员和众议员选举的时间、地点和方式，在每个州由该州议会规定）
