ICE agents generally do not need a warrant to arrest individuals suspected of being in the United States illegally when in public spaces. Under 8 U.S.C. § 1357, Congress granted ICE broad authority to question, search, and arrest immigrants without a judicial warrant, requiring only probable cause or reasonable suspicion that the person is unlawfully present and likely to flee before a warrant can be obtained.
