Why do you think that these strikes are happening when the boats are in international waters?
Because no nation has jurisdiction in international waters. Not even America. The only law which governs military action of our people in international waters is the UCMJ. When people refer to 'war crimes' about something which happens in international waters, they are referencing the Geneva Convention; however, the Geneva Convention is only applicable when both sides of the war have signed the Geneva Convention. Drug smugglers / narco-terrorists have not signed the Geneva Convention and America has no official declaration of war. Trump's orders to the military are entirely within his lawful purview to give.

 

Also, the Geneva Convention only applies to those combatants who are part of an organized military force, controlled by a higher officer, and they must wear a uniform with appropriate insignia.  No uniform, open game.
