As of October 2025, there are no longer any individuals involved in the January 6 Capitol riot in federal prison due to a mass pardon and commutations granted by President Donald Trump shortly after he took office in January 2025.

 

Key details of the clemency action:
  • Widespread clemency: The action covered nearly all of the approximately 1,600 people charged in connection with the riot.
  • Most convictions erased: Full pardons were issued to the vast majority of individuals, erasing their convictions for January 6-related offenses.
  • Sentences commuted for leaders: For the most high-profile defendants convicted of seditious conspiracy, including members of the Proud Boys and Oath Keepers, Trump commuted their sentences to "time served". This allowed for their immediate release but left their convictions on record. 
 
 
 
One notable exception was Guy Reffitt, a high-profile rioter who was released on a pardon for his January 6 conviction but remained in legal trouble. At the time of his release, he was awaiting trial in Texas on separate, unrelated gun charges and was not yet free from detention.
