The charge is not about leakage,

but about the "false statement" from Comey about the leakage. He said in 2020 congress that he did not authorize someone at the FBI to be an anonymous source to WSJ 10/30/2016 article.

On October 28, 2016, eleven days before the election, Comey notified Congress that the FBI had started looking into newly discovered emails. On November 6, Comey notified Congress that the FBI had not changed its conclusion.^[9]
