宪法第14修正案：All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. 

真正扯皮的在黑体字。有法界人士解释说，如果是合法入美国国境的，那么就是subject to the jurisdiction of US，但如果是非法入境的，则仍然是subject to the jurisdiction of his/her own country，比如入侵的外来士兵，比如到珍珠港轰炸的日本空军士兵，他们不符合宪法第14修正案的条件，所以不被保护。
