Updating means change from one lower version to a higher one.

if U R using an illegal copy and trying to overwrite it with a legal copy of the same version, just re-install. (best back up data and format OS partition). Of course, this whole operation does't really make sense because as long as U R using a currently being used CD-key, it is still illegal.
