in most states, H1b and family members pay out-state tuition. in some states (Washington, CA, etc.) in-state tuition is extended to H1b and family. It depends on the state.

Of course they know who you are. You need to provide the prove of residency before getting the in-state tuition.

Ask the university you plan to attend.
