有个报税问题,贴这不知合不合适,求明白人给讲讲

It will be the first tax return, so please help me!!
1.Both my hu*****and and I were in OPT from 2/1/08 to 9/30/08 and then changed visa status to H1 from 10/01/08. Before 2/1/08 we both were international student, I came in 2/2003 and my hu*****and came in 12/2004, if we want to fill joint which form should I do, 1040 or 1040NR-EZ?
2.We both got deducted on social security tax and medicare tax from the employer which we shouldn’t during OPT, I know I can file form 843 to claim them back but which line should I attached to 1040 or 1040nr?
