根据《中国国籍法》第四条至第七条的规定,以下人具有中国国籍:
第4条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
第5条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
第6条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
第7条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:1、中国人的近亲,2、定居在中国,3、其他正当理由。
所以,像她这种情况加入中国国籍不是问题,问题在于,有何证据证明她放弃了美国国籍?她在个人IG上只说自己决定为中国出战,但参加奥运会是允许双重国籍的,假若她并未真放弃美国国籍和她说的也不矛盾。当然中国名义上的确不允许双重国籍,但中国又不是法治国家,网开一面也不是不可行。
