请教各位老师：

２００２以亲属移民申请妹妹来美，妹妹有一个女儿，生日是１９９３。１。５。

妹妹的ＲＥＣＥＩＰＴ　（ＰＲＩＯＲＩＴＹ）　ＤＡＴＥ是２００２。９。２６，ＮＯＴＩＣＥ　ＤＡＴＥ　－　ＡＰＲＲＯＶＡＬ ＮＯＴＩＣＥ是２００９。１０。２９。在ＤＯＳ的ＶＢ看到排期是１５ＭＡＲ０１。

问题：如此估计，妹妹的女儿年龄在排期到的时候可能会超过２１岁。妹妹的女儿以ＣＨＩＬＤ身分（２１岁一下）年龄如何计算？是以ＮＯＴＩＣＥ　ＤＡＴＥ计算，还是以排期到的时候计算？

-The CSPA age = the child age when the PD is current - I-130 pending time. If the CSPA age < 21, then it is OK for the child to apply for the immigration visa with the parent. From the information you provided, the I-130 took about 7 years to be approved (10/29/2009 - 9/26/2002 = 7years plus 33 days), i.e. the I-130 pending for about 7 years, so the child should have no age-out problem. So, don't need to worry about this isssue.
