回复：加拿大公民申请美国绿卡等待期间可一直在美国居住

请教这里的各位老师和同学们：

女：中国出生，加拿大公民，

男：美国绿卡持有者，英国国籍，目前不够申请入美国籍的条件也没有打算入美国籍。

已经结婚。目前不在美国。即将搬去美国居住,女方不工作。

通常加拿大公民在美国可以呆 6个而不需签证。为长远在美国居住，女方到美国后准备申请婚姻绿卡，男方工作收入不是问题。女方并不急于拿到绿卡，主要是可以在美国长期居住就可。

有几个问题请教。

1。申请了绿卡之后，在等待绿卡的过程中，女方是否可以合法地在美国居住6个月以上直至拿到绿卡 ？

-No unless she gets another status such as F-1, H-1, etc.

还是必须离开美国，在加拿大等待？

2。申请了绿卡之后，在等待绿卡的过程中，女方去其它国家旅游后再进入美国会否有问题？

-Hard to say and may be fine if she will apply for the immigration visa in Canada.

3。考虑到以上问题 1 和 2， 申请绿卡是进入美国之后再申请呢还是目前从海外直接申请？

-The problem is that she has to wait for the priority date to be current (2.5 to 3 years), thus she can either come to US to file I-485 or apply for the immigration visa in Canada. She had better choose to apply for the immigration visa in Canada in the I-130 when her spouse files I-130, thus it will be convenient for her either to file I-485 in US or to apply for the immigration visa in Canada.

4.这类情形，是否找律师办比较好？
