老公被雷,payroll会上到5月初. 紧急求助几个转身份问题.

1. 我是H4身份,两个月前已经拿到几个学校的offer,想问一下,我申请转F1,他同时申请转F2可行吗?

-Yes.

2.是不是只要在5月之前把转身份申请寄出去,我们在美国的身份就是合法的?

-Yes.

3. 好像在哪看F1身份在I20开始日期之前30天才生效.如果转身份申请可以批准,我的I20开始日期是9月12号,是不是只有8月13号之后F身份才生效?

-Correct.

如果在8月13号之前转身份申请已经批准,那从批准之日到8月13号之间的gap怎么办呢?

-That will be a problem. So, if your spouse's employer will not withdraw the H1 immedaitely after he is laid off (he may talk to the employer not to withdraw the H1 until July), you may file F1 and your spouse file F2 application in the end of May and thus, the F1/F2 pending time will cover the period of later May to August 13. Because your spouse last paycheck will be in the end of April or early May, USCIS can not tell his unemployment befofe June (he can provide the last 3 month paycheck stubs including the April or early May one).

4. 如果老公转成F2以后,找到工作,是不是只要办理H1b transfer?

-Ask the new employer to file change fo status from F2 to H1 (equal to new H1 filing).

还是需要重新申请H1b名额?

-Not at all. He can continue to use the left 4 year H1 period.

他的H1b才用了两年.
