旧的non-cap H1B已于2011年9月过期，在这old h1b expire前申请了F1但今天得到denial notice，现在重新找到学校工作后办H1B，

1.是直接回国签还是在美国申请然后回国activate?

-Most likely the new H1 approval will have no I-94 because your F1 was denied (had gap) and thus, you need to go to China to apply for the H1 visa. So, had better use premium processing to get the result in 15 days.

2.在美国申请然后回国activate,有被拒签或check的可能吗？

-It is possible, like every case. Bring the F1 filing receipt and the denial notice with you for the H1 visa application if you have to apply for it in case the VO ask for your legal stay in US.
