我的ｐｅｒｍ是在h1b过期３个星期后批准的。

 

ＨＲ处理出现问题，使我的Ｉ１４０和Ｈ１Ｂ延期申请，不能在Ｈ１Ｂ到期日前提出。现在提交了Ｂ１申请，律师说是合法的。

-Why did the 律师说是合法的? If your H1 I-94 expired before you file B1 or F, etc., your change of status applicaityon will not be approved.

不知道可不可以在ｐｅｒｍ批准后，直接用ｉ１４０加急处理？

-Yes.

并提出Ｈ１ｂ延期３年的申请。

-Depends on whether you still have the 6 year H1 time left such as you visited China during the 6 years and then, the time you spent in China does not count as the H1 time. If so, just file the H1 extension as soon as possible for another 3 years beyond the 6 year limit, and then, wait for the RFE adn the I-140 approval, and then provide the copy of the I-140 approval notice for the RFE.

 

如果申请一个Ｆ１，是否用Ｆ１比Ｂ１好些？
