我老公的排期到了，本来是好事，但是现在已经愁死了，全因为我换工作Transfer
H1 惹得。
我02/20/2011从A 公司辞职，I94到2013年。当时有B银行的offer,但是B 银行动作
很慢，忧虑之下，我申请H4来过渡。 (H4 Receipt 是03/07/2011, 在04/01/2011
批准， 一个星期后收到)
B银行的律师04/01/2011拿到H1B transfer Receipt (他在申请材料里附上了H4得
申请，然后04/11/2011给我做了E-Verify并且通过，然后告诉我可以上班了。
我五月接到USCIS的REF，要求提供我老公的工作证明。然后六月底网上显示收到回
信，然后就再也没有消息。律师上个月给USCIS打了电话，但还是没有处理。因为这
个我天天和公司人事部吵架，我要求自己负担PP， 但是他们不同意。让我放心，不
要太急躁。
我老公的负责i 485的律师告诉我，因为我申请了H4,所以我必须在h1 transfer 批
准之后才能工作。但是一则我的h1 transfer递交在H4批准之前，当时我没有明确身
份，二则做了E-Verify并且通过，我以为银行的律师应该很懂，他说可以上班就上
班了。
我怕的要命，不是怕回国，而是孩子在这里，要是因为这个把我自己的485据了怎么
办。
我的问题有：
1。我是不是在非法工作? - You are currently H-4, thus not eligible to work legally in the US.
2。如果H1通过了，这会影响我的485吗? - Theoretically a person is ineligible to have I-485 approved for over 180 days of unauthorized employment in states
3。如果H1被据了，我可以申请H4吗，还是要回国走一堂。- You have been in H-4 since "在04/01/2011 批准"
4。要是现在是非法工作，这不是我的错啊。E-Verify都通过了，我该怎么弥补呢?- "E-Verify" constitutes none action of USCIS'
我可怜的老公为了我，排期到了也不能申请485，请各位救命。- Why can't he file I-485 which is irrelevant as I could see?
For your safety, I would suggest you to apply H-4/H-1b visa to return to US before filing I-485, but ASAP. If your H-1b is approved before visa interview, apply H-1b. When you come to US in H-4, you will need to either apply H-1b visa overseas (yes, leave and enter US again) or have employer file H-1b in order to work. You may get EAD when filing I-485, as alternate option to work.
To remain in US, you also get chance that your unauthorized employment is not caught by USCIS. "E-Verify"is not a sufficient indication that you are working.
