OPTION A: 2011年H1B额已满,如在四月递交新的H1B FOR 10/1/2012 – 10/1/2015,同样的POSITION, PREMIUM PROCESS, 批的可能性大吗?

-He can not get a neq H1 quote of 2012 because he has to stay outside US for at least one year for qualification. If he leaves US now and stay in China for one year, he can ask his employer to file a new H1 in April 2012 for the H1 quote of 2013 and he can return to US in October 2012.

OPTION B: 如果在四月份,我们可以也同时递交PERM RESUBMIT(BASED ON OLD H1B,EXPIRE IN OCT)?? 还是递了新的H1B,就不能在旧的H1B申请PERM了?

-PERM/I-140 petition is irrelevant to H1 status, and his employer can do it for any time, of course the sooner the better to him. If you get the PERM approval and hten, use premium processing to get the I-140 approved before October this year (before your old h1 expires), you can extend your old H1 for 3 years and he does not need to go to China. This is an ideal choice for him. If  he can not get the I-140 approval before October this year, you may leave US before October and then, return to US after the I-140 is approved and then, extend the H1 for 3 years beyond the 6 yea limit. So, discuss this with his employer and lawyer.

OPTION C: 如他四月回国,在境外呆10个月,到2012年二月回来,那他的H1B可以延期到2012年八月??

-Yes, but he still needs to ask the employer to file the PERM and the I-140 as soon as possible.

我们想延期的原因是: 我们在等加拿大移民结果(BASED ON H1B),但那要2012年四五月才知道,以境外呆一年以内的方法可以延期现有的H1B吗?
