1. H1B转H4再转H1B，新的H1B是不再占用每年quota的，所以可以随时开始，对吗？

-Yes.

2. 从H1B转H4的时候要file一张change of status的form I-539，辞职最好是收到receipt notice (not the approval notice)之后；从收到receipt notice到最后收到change of status approval notice中间这段时间，legal status是”change of status pending status” ，

-You can legally stay during the H4 is pending.

这段pending的时间仍然抵减H1B六年的时间？

 -No. Your H1 status stops/termiantes when you stop working for the employer.

 

3. 最关键的问题：如果在pending status期间，我找到新的工作，新雇主在重新file H1B petition的时候会有什么practical的问题吗？

-No problem, but the problem is that is the H1 is approved first, and the H4 is approved later, your status will be H4 and you ahve to file the H1 application again. Of course, if the H4 is approved first and the h1 approval later, you will be fine.

是要再file一个什么form去withdraw之前的I-539吗？

-You can not withdraw the H4, otherwise your status will have gap from the date you quit the job to the date your H1 filing.

这样会confuse USCIS导致新的H1B不被批准吗？或者USCIS手里同时有两个case，一个是之前file的change of status I-539，一个是新的H1B petition，他们会不会弄乱了？

很多recruiter都建议H1B的人不要这么折腾，要等新的H1B petition file上去了再辞职，
