Your hu*****ands needs to file the I-864 even if he has no enough income (the major sponsor has to file the I-864 no matter whether you need the co-sponsor). of course your brother also needs to file the I-864 as the co-sponsor. So, just ask your hu*****and to file the I-864 with providing the 2010 tax return to respond to the RFE following the USCIS RFE letter. Enclose the USCIS letter in the response so that USCIS can know your I-864 and the support documents are for your case.
