Hi, first let me say thank you since for some reason I could not post my thanks under another thread I started.

Second, I am in consideration of filing I-130 for my older sister and her family in China. My question is :

 1. Is a copy of I 864 have to be filed along  I 130 or the to be file when is time to I 485?

-Not need I-864 filing with the I-130 at this point. The national Visa center will send you instructions to request this I-864 and other documents after your I-130 approval a few years later. Because your sister is in China, she can not file I-485, but apply for the immigration visa in the US Consulate in Guangzhou when the PD is current about 9 years later.

2. my older sister's older daughter is 15 right now, will she be bind by the 21 year old rule, when is her age counted? the time I file the paper work or the time they are ready to get a green card(get a immigration visa)?
