回复：H1b->F1对485有影响吗？

诸位老师，我现在是h1b第10年。07年7月交的EB3 485,140在07年8月就批了。priority date是04年的9月。

我现在没有使用EAD，还是继续持有h1b

现在看起来，我有可能在2011年的秋季去继续PhD.而现在的排期很有可能在这之前下不来绿卡。我不太清楚是否这样会导致485的申请被作废。有什么办法可以继续保持我的485吗？

-The change of status will not affect your I-485, but the problem is that your status change from H1 to F1 will not be approved due to your immigration intent (I-140 and I-485 filing). So, the only way for you to study full-time and also keep your lawful presence is that if you are married and your spouse is h1 holder, then you can change your status to H4 and then study full-time. Otherwise, you can not quit your job to study full time. Of course, you can work as H1 holder and study part time.
