我今年7月办的新H1b，当时公司不帮老公一起申请，我们想他的反正要12月才过期，就没有push一起递。现在我们是485pending，用AP回国回来后I-94上写了AOS。我还是想帮他把H4延下去，以前都是单位办的，没有自己办过。我在网上查了一下，没有找到官方的具体要求，
-If you also used AP to entered US after your h1 extension approval, your spouse can not extend his H4 because your status is not h1, but parolee or AOS, though you still can use the H1 benefits such as working without EAD, etc. If only he used AP, he can extend his H4 (see the following).

-File I-539 based on the I-539 instructions from USCIS website and provide copies of your H1 approval notice and your rcent 3 month paycheck stubs, your marriage certificate, his H4 approval notice, his parolee I-94 (entered US with AP), and any other documents required by I-539 instructions.
