-No. He has to change his status to H4 at the same time when you change your status to H1, otherwise he has to leave US before your H1 is approved. Then, he can apply for the H4 visa to come back.

2. 如果我的H-1B批准了，那么如果我爱人还在美国的话，有多长时间的合法逗留期呢？

 

是不是必须在我H-1B批准之前出境？

-Correct if he does not file the H4 application with your H1 application.

或者这样问：这次不申请我爱人的H4，他最迟什么时候必须离境回国才是合法的？
