尊敬的皮匠老师和86老师，请教关于申请H-1B的问题：

我准备下周五（12月3日）之前将我的申请表快递出去，我没申请加快办理。现在我的疑问是：最近帖子上都说不加快的H-1B的批准周期在4.5个月，这样推算的话，如果我的case被批准，就已经到了2011年的4月中旬了，那么我这样的案子的配额是算在今年的配额里面还是算在2011年4月以后的配额里面呢？

-There is the 2011 h1 quote available at this moment and if you file your application now, you still have a very good chance to get the 2011 quote. There is not different chance to get the h1 quote between regular processing and premium processing because whether you get the H1 quote depends on the h1 petition receipt date, not premium processing or regular processing. 

这样跟明年4月份的交错的处理时间对我的案子有影响吗？

-No. But if you can not get the 2011 H1 quote, your h1 petition will be denied. Then, you have to file it again after April 1, 2011 for the 2012 h1 quote.

您能不能给个建议，我是否需要办加快？

-Not need if you do not want to.

我没办加快的原因有三，一是申请费都是自己掏钱，二是申请下来就开始扣税（现在钱太少，扣税就更少了），三是我的J1到2011年的9月底。

另外一个问题再请教：

听说到美国三年才开始扣税，我2009年的7月到美，之前的J1不扣税，转H1之后是扣税还是不扣税

-After you change your J1 to H1, you have to pay the income tax because you can not use the benefit of the treaty between China and US anymore.
