回复：再帮LG问下：h1b明年1月到期，公司在等140(已经等了5个月了)批了再办延期

140都等了5个月了还没有批，不知道什么时候才能批下来。老公公司想140批了，可以延3年h1b。可是就怕等到1月140还没有批，然后再申请h1b延期是可以暂时维持合法身份，但是万一被拒了就糟了。因为我自己现在工作还没有搞定，怕到时候全家都没有合法身份就得回国了。

这个140五个月还没有批正常吗？老公同事今年2个月就批下来了呀。

-May ask the employer or lawyer to call USCIS to see what is going on and push them to speed it. Also may consider using premium processing if necessary. nayway, your spouse has to file the h1 extensiobn before his current h1 expires and that is critical for your all family status.
