AOS不是可以和H/L dual status的么?为什么用了AP就不是L1了呢?
-There is not dual status, but dual intent. Using AP does not affect L/H benefits such as you can work continually without EAD, but the status is not L/H after using AP. A person status normally is indicated in the I-94, and after you use AP, your I-94 is Parolee, not L/H.
还有一个问题,如果用了AP就不是L1,这样AOS在申请H1的时候也不被认为是有效身份?
-Correct. The H1 or L1 is sponsored by the employer, and the H1 petition approval does not mean the employee H1 status is also approved. Only If the H1 approval has the I-94, then the emplpoyee's H1 status is also approved. If the H1 approved has no I-94, the employee needs to go outside US to get the H1 visa because the employee has no h1 status yet. Thus, the employee will get the H1 status (H1 I-94) at the port of entry when he enters US using the H1 visa.
