回复：AOS境内转身份L到H的问题，请有经验的帮忙看看

我的L签证马上就过期了（5年），公司今年7月帮我申请转到H1-B的身份来延期。

我09年进入美国的时候用的是AP入境，AP的I-94因为AP一年有效原因是到今年5月过期。虽然今年5月之前我已经延期过AP到2011年过期了。

不知道是不是这个I-94的原因，我现在收到的H1B的批准是797B而不是797A。咨询公司律师后，他们说移民局因为我的AOS而拒绝了我的转身份，律师要我L过期之后出境激活H1。。。

-The problem is that after you used AP, your status was not L1, but parolee or AOS even if you do not need EAD to work. You can get back to L1 status by extension of the L1 or get the L1 visa outside US, but you can not change from L1 to h1 before that because your status was not L1 after you used AP. That is why your H1 approval has no I-94. You need to go out of US to get the h1 visa to activate your h1 status before your L1 expires and come back in advance up to 10 days before the h1 effective date, not "L过期之后出境激活H1". 

看了皮匠的一些博客，我觉得像我的情况（dual status）不应该收到797B，因为我申请转身份的时候是拥有有效status的，我的理解对么？公司律师是否应该帮我file 一个ammendant给USCIS解释呢？
