朋友 H4时递交了485 （以家属 身份），现在 485 Pending

但是他的配偶 （注申请人 的 485 却 先 批了）

导致 朋友 现在似乎 没有了合法 身份

其 单位 现在 要 给他 申勤 H1B,发现不能 在 境内 转换，只能 到 境外 去 激活

另一个 问题是 朋友 以前 大约 有 5 个月 的 out of status 状态 （期间虽然 合法在 美国 停留，但是 没有了合法身份）

请问 在 这种 情况下

朋友 去境外 申请 H1B 签证, 会得到 批准 马？

-Because his status is not H1 or H4 and if he leave US without AP, his I-485 will be affected. So, he can not get the H1 visa outside US without affecting his I-485. Only one choice is that he may apply for the EAD to work.
