-Because I-539 is not required for H4 to H1, you can not find this requirement in the I-129 Instructions. Just tell the lawyer that you have read the I-129 Instructions and do not find that I-139 is required for H1 petition. Also tell him/her that many of your friends/co-worker/colleagues who have the same situation as yours did not file I-539 when they changed their status from H4, F1/F2,J1/J2 etc. to H1 status. Then see what he/she says.
