I am Graduate research assistantship (GRA) (20 h per week), now, I am pre-OPT full time employment, from Oct to Dec, 2009 before graduation.
-Did you get the EAD (OPT based) and was it effective before you worked at the full-time job in Oct.? If no, you may have status violation if you accept the payment for more than 20 hours/week job because F1 status only can work on-campus at a maximum of 20 hours/week in the regular semester.
After graduation, from Jan 1, it is Post OPT employment, my question is follows:
1. During the Oct through Dec, 2009, new unit pay my full time salary, but the my university pay also my salary for GRA. My university said that if we do not pay your salary, it is means your GRA has been stopped, you may need pay tution for final semester, it is cost your lots of money, after graduation, you should return the money to university, because international student can not receive double pay. It is true?
-If you have the effective OPT EAD, you have no problem to accept the payment.
If the GRA is less 20 h per week, (already reduce from 20 h to 13 h per week), it still need to return the money to university ?
-If you do not have the effective EAD, you can only get paid at a maxmium of 20 hours a week. So, just decline or return the extra money to the unit who paid you.
2. Can I do full time OPT employment and part time GRA (13 h or less 20 h per week) during the pre OPT periods?
-No, unless you have the OPT based effective EAD.
