简单讲一下我的情况。H1b公司被要求补材料。我的I20 将在12月31日过期，而这学期12月18日结束。但是律师说实际要按照program什么时候结束，grace period就什么时候开始。那就是说grace period在12月19日就开始了。

那么我现在F-1到底要不要延期呢？
1)如果不延，用grace period，会不会影响h1b的申请呢？
-No negative effect.
而且万一最后h1b被拒了，我不就没有合法身份了吗？听说grace period里虽然可以transfer of program,但因为是grey area，有时候会transfer不了。到时候就麻烦了。
-You can go out of US to get F1 visa to come back if H1 application is denied. As long as you get a new I-20 during the grace period, you have no problem to get the F1 visa.
2）如果延期的话，万一律师把H1b 的RFE材料递上去，h1b批了下来，而F1的延期后批下来，那么根据last action rule, 我的h1b是不是就废掉了？
-Correct.
3）想再问一下PJiang老师，关于RFE补材料，如果律师交材料晚了，h1b的名额有可能用完。您的意思是不是这样的：如果有60000个名额，前面59999个都批了，算占了名额，现在还剩一个。那么我现在作为第 60000个申请人递交申请，移民局受理了，并rfe.如果这个时候，还有第60001个人继续递交申请，移民局也接着受理，对吗?
-Yes, they still accept the new application until no quote left and then, deny the applications beyond the quotes.
而且如果这第 60001个人材料没有问题，直接批了，那么我就没名额了，对吗？
-Correct, if USCIS make a decision on this application ahead of yours. But if your REF another person's application are received at the same time and there is one quote left, your case will be processed first and get that quote.
这个地方我觉得有点奇怪，移民局难道不应该先处理完我的材料再去处理别人的吗？
-The only thing you need to do is to send the REF as soon as possible, and let God deal with it.
