回复：走投无路，H1六年后离境1年重新申请H1的问题

我的六年H1明年10月1日到期，因为没有申请绿卡，只能明年(2010年)9月底回公司中国分部工作一年，我的问题是2011年4月份公司能为我申请2011年10月1日开始的新的3年H1吗，因为到2011年10月新H1生效时我就满足出境一年的条件了，但是在4月份申请时只离境了半年，会被批准吗？
-It should be OK because the h1 is effective on Oct.1. But if you can ask your employer to file PERM for you now and then you can use premium processing to get your I-140 approved, you may still have time to extend your h1 beyond the 6 year limit. Even if you go back to China to work, the PERM and I-140 appication is still valid, and thus you can file I-485 when you come back if your PD become current.

So,, just go ahead to do the green card application as soon as possible.
