Your lawyer is right. Usually, USCIS need to take some time to put the approved H1 case information into their system. You need to check it with USCIS to see whether your case has been put into the online system before you go out of U.S. to apply for the H1 visa.

Anyway, you will be fine and do not need to worry about that.
