Need help, thanks in advance!

I have been holding academic H-1 visa (postdoc) for almost a year, after that, I changed it to H-4 (dependent). Right now, there is an industry position available. My question is: if I apply for H-1 again, is the new H-1 application counted in that quota? When can be the earliest time for me to work legally? Thanks a lot!
