You would be still in status(legal)合法, if you either filed a motion to reopen with USCIS or refiled a new 485 with USCIS, or you still have a valid H1B.

USCIS gives u 30-33 days to file a MOR. After MOR has been filed, you can apply EAD or renew EAD.

Processing time for MOR varies from 2 months to 1 year.
