If you are EB3, your lawyer is correct;
If you are EB2/EB1, you should file 485 right away. The problem is you don't have your 140 receipt number to file 485. If you don't receive the 140 receipt by Sep28, you should refile 140 and send 140 in the same package as 485.
After you have done this if you are EB2, then you fire your lawyer immediately, and then report to state lawyer bar. If you refile 140 due to no 140 receipt, you can ask for refund from your lawyer.
