1。房产交易中，买方反悔是否能要回deposit?  (加州）

purchase contract　(CAR)　

a) 允许buyer 从seller 接受 offer 或 buyer 接受 counter offer　那天开始算起１７天内，如果contigency conditions(贷款，房检） 不能移除, 取消合约；
b) 在escrow　签字后，有联邦法律下的3天反悔期 (three-day right of rescission) 给予primary residence的 re-finance borrower(s) 取消合约，investment property or second home property borrower(s) 不可以反悔 cancel the transaction.  买房者没有3天反悔期
c) 没有上述 a) or b) 的条件存在，在closing 后反悔，最好的情景是房价涨了，seller 反悔了，buyer 可以拿回deposit， 最糟糕的情景是seller, listing agent, buyer agent, 一怒之下把你告到法庭。

2。Dual Agent 到底代表哪方利益？

Dual Agent 必须保持在交易中的公正，因为dual agent commission是由seller 支付，大部分dual agent 要保护的是seller 的权利，
a) 保护比dual agent 的买方提供更高价的客户的公平交易；
b) 维护seller 权利，强迫dual agent 必须disclose 所有送出offer的买方。
