At this time, my clients are demanding that you refund $1,253 of said deposits back to them via cashier's check made payable to Mr. and Mrs. X and mailed to my office so that it is received no later than June 25, 2012.
As you may be aware, Section 92.109 of the Texas Property Code states that a landlord who retains a security deposit in bad faith is legally liable fo the sum of $100 plus 3x the portion of the deposit wrongfully withheld plus the Tenant's reasonable attorneys fees in a lawsuit to recover the deposit. My clients are fully prepared to file an appropriate lawsuit against you to recover said damages in the event that you do no comply with the above stated demand.

其实我大部分他搞坏的东西都有照片记录。不过有的东西没办法照相,比如说trash disposal,或者有些damage是边修边发现的,就忘了照相。
有的材料用的是原来买的多剩下的东西,所以发票的日期和数量不对。
大部分修理我付支票,少数的因为数目小,handyman坚持要现金,我就给了现金,没发票。
他觉得他不应该付carpet cleaning, house cleaning service, 其实这些我觉得在德州应该是房客付的。
另外有些东西他确实搞坏了,不过还能凑合着用,所以没有换。
如果真要打官司,我必须每一条都要用发票证明吗?
我还真不是slumlord,爱惜房子的房客搬走,我一般不扣钱,或则只扣他们损坏的东西的一点钱。他们实在是太糟糕的房客。
不过我也不想打官司,我没有时间跟他们耗。所以我想着让一步,稍微退他一点钱把这事给了了。但我不能按他要求的退,确实他损坏的东西太多了,我的损失远远不止750块。
所以我想和他negotiate一下,有几个问题。
我应该找他还是找他的律师?
我自己要不要请律师,如果请,大概多少钱?
如果我不找律师,自己和他们谈,我要注意哪些方面?不想被他们抓住把柄。
他们人已经不在本地了,他的律师能代表他们出庭告我吗?
如果真要出庭,是不是不光他们不同意的东西我要出具证明,他们同意是他们搞坏了的东西我也要出具证明和发票。
